These terms cover your use of Memofyd — the desktop application and the service behind it. Using it means accepting them. Memofyd is operated by Harshit Kumar (“we”, “us”). Contact: harshitk55@gmail.com.
Memofyd is early-access software provided as-is. Features may change or be removed, and there may be interruptions. Do not use it as the only record of anything you cannot afford to lose — keep your own notes of genuinely critical decisions.
You need an account, and you are responsible for what happens under it. Sign-in codes are sent to your email address, so keep control of that address. Tell us promptly if you believe someone else has access.
You must be at least 16 years old.
This is the most important clause here. You are solely responsible for making sure every recording you make is lawful where you and the other participants are.
Many jurisdictions require the consent of everyone in a conversation before it may be recorded, and rules on recording telephone calls are stricter still — including in India. We provide a recording tool; we do not and cannot obtain consent on your behalf, and we do not check whether you have it.
Tell people they are being recorded. If someone objects, stop. You agree to indemnify us against claims arising from recordings you made without the consent you needed.
Accounts doing any of the above may be suspended without notice.
Your recordings, transcripts and notes are yours. We claim no ownership of them.
You grant us only the permission technically necessary to run the service: to store your content, and to process it — including sending it to the transcription and analysis providers listed in the Privacy Policy — so the product can do what you asked. We do not use your content to train models, and we do not sell it.
Every account gets 60 minutes of recording free, once. Paid plans include a monthly allowance of recording hours, which resets monthly including on yearly billing.
Recording past a paid plan's allowance is permitted and billed at the overage rate shown on the pricing page, so a recording is never cut off mid-meeting. The free allowance simply ends; anything captured up to that point is kept and processed normally.
Payments are handled by Paddle as merchant of record. Paddle is the seller for your purchase and their terms also apply to the transaction. Prices are in US dollars and exclude any tax Paddle is required to add.
You may cancel at any time; the plan runs to the end of the period you have paid for and does not renew. We do not give partial refunds for unused time, but if something went genuinely wrong, write to us — we would rather sort it out than argue.
There is no uptime guarantee during early access. The service runs on a single server and will occasionally be unavailable for maintenance or updates.
You may delete individual conversations in the app at any time; this permanently removes their audio, video, transcript and derived notes. To delete your whole account, email us and it will be done within 30 days. Records of recording minutes used are retained for billing integrity, as set out in the Privacy Policy.
Memofyd connects to Google, Recall.ai, OpenAI, Deepgram, Linear and Paddle. Their own terms govern their services. If one of them is unavailable, the corresponding feature of Memofyd will be too.
To the fullest extent the law allows, Memofyd is provided without warranties of any kind. We are not liable for indirect or consequential loss, for lost profits, or for loss of data. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim.
Transcripts and summaries are produced by automated systems and will sometimes be wrong. Do not rely on them as a legal or medical record, and check anything that matters against the audio.
We may update these terms. If a change materially affects your rights, the date above changes and you will be notified by email before it takes effect. Continuing to use Memofyd after that constitutes acceptance.
These terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute arising from them.
